Privacy Policy
Last Updated: 3/16/2026
At Fluctuate Therapy, we are committed to protecting your privacy and the confidentiality of your personal health information. This Privacy Policy explains how we collect, use, and protect your information when you visit www.fluctuatetherapy.com and engage in our counseling services.
We have separate individually licensed practices which strictly adhere to the Health Insurance Portability and Accountability Act (HIPAA) and Washington State’s Uniform Health Care Information Act (UHCIA). Where Washington State law provides stricter privacy protections than HIPAA, we follow Washington State law.
1. Information We Collect
Website Data: We do not use tracking for ads. We do have a presence on Google’s Business profile so that we have an address on Google Maps.
Contact Forms: If you reach out to us via our website contact form, we collect the information you voluntarily provide, such as your name, email address, phone number, and brief message.
Protected Health Information (PHI): Once you become a client, we collect personal health information necessary to provide you with counseling services.
2. Digital Communication and Telehealth
While we utilize secure, HIPAA-compliant platforms for telehealth sessions and our electronic health records, standard email and SMS text messaging are not completely secure.
Email & Texting: We ask that you limit standard email and text messages to scheduling or administrative inquiries only. Please do not send sensitive clinical information via unencrypted email or text.
Telehealth: All virtual therapy sessions are conducted via a secure, HIPAA-compliant video platform to ensure your privacy.
3. How We Use Your Information
We use your Protected Health Information (PHI) primarily for:
Treatment: To provide, coordinate, and manage your therapy.
Payment: To process payments, provide superbills, and verify insurance coverage if applicable.
Healthcare Operations: To run our practice efficiently, such as conducting quality assessments or contacting you for appointment reminders.
4. The Limits of Confidentiality
What you discuss in therapy is strictly confidential. We will not share your information without your written consent, except in specific situations mandated by Washington State and federal law. These exceptions include:
Risk of Harm: If we believe you are in imminent danger of harming yourself or another specific person, we are legally required to take protective action, which may include contacting emergency services or the intended victim.
Abuse or Neglect: As mandated reporters in Washington State, if we have reasonable cause to suspect that a child, elderly person, or vulnerable adult is being abused or neglected, we must report it to the appropriate state agency (e.g., CPS or APS).
Legal Proceedings: We may be required to disclose information in response to a valid court order or a subpoena signed by a judge.
5. Minors and Privacy in Washington State
In Washington State, the age of consent for mental health treatment is 13 years old. If a client is 13 or older, they have the legal right to confidentiality. We cannot share their therapy records or specific details of their sessions with parents or guardians without the minor’s explicit written consent, except in life-threatening emergencies or cases of suspected abuse.
6. Your Rights Regarding Your Information
Under HIPAA and Washington law, you have the right to:
Request a copy of your health and billing records.
Request corrections to your records if you believe they are inaccurate.
Request confidential communications (e.g., asking us to only contact you at a specific phone number).
Request a list of the disclosures we have made of your information.
Revoke your consent to share information at any time.
7. Full Notice of Privacy Practices
This website policy is a summary of our privacy practices. All clients receive a comprehensive, legally detailed Notice of Privacy Practices (NPP) through our secure client portal prior to their first session.
